Welcome to POLE™.

These Terms & Conditions (“Terms”) govern your access to and use of pole-engine.com and any purchase made through the website.

By accessing the website or placing an order, you agree to these Terms. Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

 


 

1. ABOUT POLE™

POLE™ is an independent fashion and lifestyle brand based in Italy.

2. INDEPENDENT BRAND NOTICE

POLE™ is an independent fashion and lifestyle brand.

Unless expressly stated otherwise, POLE™ is not affiliated with, endorsed by, sponsored by, licensed by, or officially connected with any motorsport championship, governing body, racing team, driver, automotive manufacturer, event organiser, or other third-party rights holder.

Any third-party names, trademarks, references or intellectual property that may appear in editorial, cultural or descriptive contexts remain the property of their respective owners.

No reference to a third party should be interpreted as implying an official commercial relationship, endorsement, sponsorship or collaboration unless POLE™ expressly states otherwise.

 


 

3. PRODUCTS

We aim to describe and display our products as accurately as reasonably possible.

However, colours, textures, proportions and other visual characteristics may appear differently depending on your device, display settings, lighting and production variations.

Minor variations between individual garments may occur as a result of manufacturing, printing, dyeing or finishing processes and do not necessarily constitute a defect.

Product measurements and size information are provided as guidance. Customers are responsible for reviewing the relevant size information before purchasing.

 


 

4. PRODUCT AVAILABILITY & LIMITED RELEASES

Certain POLE™ products may be released in limited quantities or for a limited period.

Where a product is described as limited, availability is subject to remaining stock or the specific conditions stated on the relevant product page.

Adding an item to your cart does not reserve it.

Products are only secured once checkout has been successfully completed and the order has been accepted.

High demand may occasionally result in simultaneous orders exceeding available inventory. If we are unable to fulfil an order after payment, the affected customer will be informed and refunded.

POLE™ does not guarantee that sold-out products will be restocked.

 


 

5. PRE-ORDERS

Some products may be offered on a pre-order basis.

A pre-order allows you to purchase a product before it is ready for immediate shipment.

Unless otherwise stated on the product page:

  • the full purchase price is charged when the pre-order is placed;

  • estimated production or shipping periods are estimates and may change due to manufacturing, logistics or circumstances outside our reasonable control;

  • pre-order products may ship separately from products that are immediately available;

  • material changes to an estimated shipping period will be communicated where reasonably possible.

The fact that an item is sold on pre-order does not affect any mandatory consumer rights available under applicable law.

Where POLE™ is ultimately unable to supply a pre-ordered product, the amount paid for that product will be refunded.

 


 

6. ORDERS & CONTRACT FORMATION

By placing an order, you are making an offer to purchase the selected products under these Terms.

After placing an order, you will normally receive an electronic confirmation.

An automated acknowledgement of your order does not prevent POLE™ from subsequently cancelling or refunding an order where there is a legitimate reason to do so, including:

  • product unavailability;

  • an obvious pricing or technical error;

  • payment failure;

  • suspected fraud or unauthorised payment activity;

  • incorrect or incomplete delivery information;

  • restrictions preventing us from lawfully supplying the product to the destination.

Any such action remains subject to applicable mandatory consumer law.

We reserve the right to limit quantities where reasonably necessary to protect product availability, prevent fraud or address technical issues.

 


 

7. PRICES

Prices are displayed in the currency shown on the website or checkout.

The final amount payable, including applicable taxes and delivery charges collected by POLE™, will be displayed before the order is submitted.

For international orders, additional import duties, customs charges, taxes or handling fees may be imposed by the destination country.

Where such charges are not collected by POLE™ at checkout, they may be payable separately by the recipient.

More information will be provided in our Shipping Policy where applicable.

 


 

8. PRICING & TECHNICAL ERRORS

We make reasonable efforts to ensure that product information and prices are accurate.

Occasionally, an obvious pricing, stock, description or technical error may occur.

Where an obvious error has occurred, POLE™ may correct the information and, where permitted by applicable law, cancel the affected order.

If an affected order has already been paid and is cancelled, the relevant amount will be refunded using the original payment method.

Nothing in this section limits mandatory rights available to consumers.

 


 

9. PAYMENTS

Payments may be processed through Shopify Payments, PayPal, and any other payment methods displayed at checkout.

Payment methods available to you may depend on your country, currency or device.

Payment information is processed by the relevant payment provider in accordance with its own terms and privacy practices.

POLE™ does not directly store complete payment-card details where payment processing is performed by third-party payment providers.

An order may be cancelled if payment cannot be authorised or is subsequently identified as fraudulent or unauthorised.

 


 

10. PROMOTIONS & DISCOUNT CODES

From time to time, POLE™ may offer promotional prices, early access, discount codes or other benefits.

Unless expressly stated otherwise, promotional offers:

  • may be limited in time or quantity;

  • may apply only to selected products or customers;

  • may be withdrawn or corrected in the event of an obvious technical error or abuse;

  • have no cash value.

Any specific conditions communicated with a promotion form part of that promotion.

Mandatory rules concerning price reductions and consumer protection remain unaffected.

 


 

11. SHIPPING & DELIVERY

POLE™ ships internationally to destinations made available at checkout.

Available shipping methods, estimated delivery periods and applicable charges may vary by destination and will be communicated during the purchasing process or in our Shipping Policy.

Delivery estimates are not guarantees unless expressly stated otherwise.

International shipments may be subject to customs procedures, import duties, local taxes or delays outside POLE™'s reasonable control.

Nothing in this section affects statutory rights relating to delivery.

 


 

12. RIGHT OF WITHDRAWAL — EU/EEA CONSUMERS

If you are a consumer residing in the European Union or another jurisdiction providing an equivalent mandatory right of withdrawal, you may have the right to withdraw from your online purchase without giving a reason.

For consumers protected by the EU statutory right of withdrawal, the withdrawal period is generally 14 days from the day on which you, or a third party designated by you other than the carrier, receives the goods, subject to applicable law.

To exercise this right, you must communicate your decision to withdraw clearly to:

within the applicable withdrawal period.

After communicating your withdrawal, the goods must be returned within the period required by applicable law.

Unless POLE™ expressly agrees otherwise or applicable law requires otherwise, the direct cost of returning the goods is borne by the customer.

Products should be returned without unnecessary handling beyond what is reasonably necessary to establish their nature, characteristics and fit.

Where permitted by law, the customer may be responsible for any reduction in value resulting from handling beyond what would reasonably be permitted when examining the product in a physical store.

 


 

13. REFUNDS FOLLOWING WITHDRAWAL

Where a valid statutory withdrawal right is exercised, POLE™ will refund payments as required by applicable law.

For EU consumers, this generally includes the purchase price and the cost of the least expensive standard delivery method offered for the original order.

Additional delivery costs resulting from the customer's choice of a more expensive delivery method are not required to be refunded where applicable law permits.

Refunds will normally be issued using the same payment method used for the original transaction unless otherwise agreed.

Where permitted by applicable law, POLE™ may withhold the refund until the returned goods have been received or the customer provides evidence that they have been sent back, whichever occurs first.

 


 

14. SIZE CHANGES

Due to the limited nature of certain POLE™ releases, we cannot guarantee direct size exchanges.

Where permitted, the standard procedure is:

return the original product → receive the applicable refund → place a new order in the desired size.

Availability of another size is not guaranteed.

This policy does not affect statutory rights relating to defective or non-conforming products.

 


 

15. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If you receive a product that is defective, damaged, incorrect or otherwise does not conform to the contract, contact us at:

Please provide your order number and reasonable evidence of the issue where necessary to allow us to assess and resolve the claim.

Customers retain all mandatory statutory rights and legal guarantees applicable in their country.

Nothing in these Terms excludes or limits liability or remedies that cannot lawfully be excluded or limited.

 


 

16. FRAUD & ABUSE

POLE™ may refuse, suspend or cancel an order where there are reasonable grounds to suspect:

  • fraudulent activity;

  • unauthorised payment use;

  • identity or payment manipulation;

  • automated purchasing abuse;

  • deliberate exploitation of a technical error;

  • abuse of promotions, refunds or chargebacks.

Any payment collected for an order that is validly cancelled will be handled in accordance with applicable law and payment-provider requirements.

 


 

17. INTELLECTUAL PROPERTY

Unless otherwise indicated, the POLE™ website and original materials created for POLE™, including its branding, logos, original graphics, product designs, photographs, videos, text, artwork, layouts and creative materials, are owned by or licensed to POLE™ and are protected by applicable intellectual-property laws.

No content from the website may be reproduced, distributed, modified, commercially exploited, republished or used to create derivative commercial material without prior permission, except where permitted by law.

POLE™ is currently used as a brand identifier. The ™ symbol does not constitute a representation that the mark is registered in every jurisdiction.

Third-party intellectual property remains the property of its respective owners.

 


 

18. USER-GENERATED CONTENT

We may invite customers and members of the POLE™ community to submit photographs, videos, reviews or other content.

Where you directly submit content to POLE™ for the purpose of being featured, reposted or published, you confirm that:

  • you have the right to submit that content;

  • its intended use does not knowingly infringe third-party rights;

  • any individuals clearly identifiable in the content have provided any permission required for the intended use.

Any licence or permission granted to POLE™ will be limited to the scope communicated or reasonably understood when the content is submitted.

Simply tagging, mentioning or following POLE™ on a social platform does not, by itself, transfer ownership of your content to POLE™.

Where appropriate, POLE™ may request permission before using third-party social content for commercial purposes.

 


 

19. WEBSITE CONTENT

We may update, modify or remove website content, collections, product information and availability from time to time.

We do not guarantee uninterrupted or error-free access to the website.

We may temporarily suspend access for maintenance, security, technical reasons or circumstances outside our reasonable control.

 


 

20. THIRD-PARTY SERVICES

The website may rely on or link to third-party services, including payment processors, shipping providers, social platforms and other technology providers.

Third-party services may be governed by their own terms and privacy policies.

POLE™ is not responsible for independent third-party services to the extent permitted by applicable law.

 


 

21. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits mandatory consumer rights or liability that cannot legally be excluded.

To the maximum extent permitted by applicable law, POLE™ will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from circumstances outside our reasonable control.

If you are purchasing as a consumer, these Terms do not exclude any rights or remedies provided to you by mandatory consumer-protection legislation.

 


 

22. INTERNATIONAL CUSTOMERS

POLE™ operates from Italy and may accept orders from customers in multiple countries.

Customers are responsible for providing accurate delivery information and for complying with any lawful import requirements applicable in their destination country.

Local customs duties, import taxes or similar charges may apply.

The availability of the website in a particular country does not necessarily mean that every product can lawfully be delivered there.

POLE™ may restrict destinations or products where reasonably necessary to comply with applicable law or logistics requirements.

 


 

23. PRIVACY

Personal data is processed in accordance with our Privacy Policy.

Our use of cookies and similar technologies is described in our Cookie Policy and managed through the consent mechanisms made available on the website where required.

These policies form separate notices and should be reviewed alongside these Terms.

 


 

24. CHANGES TO THESE TERMS

We may update these Terms from time to time, including to reflect changes to our business, website, products or applicable law.

The Terms applicable to an order are generally those made available to the customer at the time the relevant order is placed, except where a change is required by law.

The latest version will be published on this website with its revision date.

 


 

25. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the extent legally permitted or will be severed where appropriate.

The remaining provisions will continue to apply to the extent permitted by law.

 


 

26. GOVERNING LAW & CONSUMER RIGHTS

These Terms and contracts concluded through the POLE™ website are governed by Italian law, subject to applicable conflict-of-law rules.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections that apply under the law of your country of habitual residence where those protections cannot lawfully be excluded by agreement.

Nothing in these Terms requires a consumer to waive any mandatory right regarding jurisdiction, dispute resolution or access to courts provided by applicable law.
